ARREST MADE IN ROUTE 37 HIT & RUN

Toms River, NJ – Ocean County Prosecutor Joseph D. Coronato and Toms River Police Chief Mitch Little announce that on March 18, 2015, the Ocean County Prosecutors Office and Toms River Police Department completed a joint investigation that culminated in the arrest of Mark Rothlein, 51, of Vansant Avenue in Island Heights for the March 6, 2015 hit and run that claimed the life of Jeffrey Michel of Colts Neck.

Earlier this week, the partnering agencies released a description of a vehicle that was suspected to be involved in the accident, along with a small piece of the vehicle located at the scene and determined to be from a Blue Jeep Wrangler manufactured between 2013 and 2015.  On March 18, 2015 at 1:20 pm, that information would lead to the arrest of Rothlein at his Island Heights home by Ocean County Prosecutors Detective Mike Proto and Toms River Traffic Safety Officer Ken Thomas. 

Rothlein is charged with a second degree Criminal Offense of 2C:11-5.1, Leaving the Scene of a Motor Vehicle Crash Resulting in Death.  He is currently being held on $100,000 bail.  The Blue 2013 two door Jeep Wrangler that is registered to his wife, has been impounded for processing by the Ocean County Sheriff’s Department CSI.

ORIGINAL RELEASE:

On March 6, 2015 at 8:20 pm a motorist was traveling West on Route 37 near Fischer Boulevard. He observed a person lying on the side of the road just West Of Fischer Boulevard.  Toms River Police Officers arrived they located a 27 year old Colts Neck Man who was unresponsive.  Jeffrey Michel, of Cedar Drive, was pronounced dead at the scene.  It appears that he was struck by a vehicle traveling west that may have been blue in color.  Toms River Traffic Safety Officer Ken Thomas is conducting the investigation along with Ocean County Prosecutors Office Detectives and Mike Proto and David Margentino. The Ocean County Sheriff’s Office CSI Unit was also on hand to process the crime scene.  Anyone with information should contact Officer Ken Thomas at 732-349-0150 extension 1314 or Detective Mike Proto at 732-929-2027.

INDICTMENT IN LAKEWOOD HIGHPOINT CONDO MURDER

Lakewood, N.J. – Ocean County Prosecutor Joseph D. Coronato announced the indictment yesterday of Umbachi Jackson, 20, of Lakewood, for the August 29, 2013 murder of Kenneth Scott, 24, at the High Point Condominium Complex in Lakewood.  The Ocean County Grand Jury returned a three-count Indictment charging Umbachi G. Jackson, Jr. with: first-degree Murder; second-degree Unlawful Possession of a Handgun; and second-degree Possession of a Handgun for an Unlawful Purpose.  Jackson’s bail, as set by the Honorable Superior Court Judge Francis R. Hodgson, Jr, J.S.C., remains at $1,000,000 cash only.  He has been continuously incarcerated since the time of his arrest in December of 2014.  He is represented by Robin Lord, Esq.

The indictment stems from an incident which occurred on August 29, 2013 at approximately 9:53 pm. Lakewood Police responded to the High Point apartments, in the area of building 524, regarding a male with a gunshot wound.  Upon their arrival, they found the male victim and immediately had him transported by EMS to Jersey Shore Medical Center in Neptune.  The victim, who was initially admitted in critical condition, later succumbed to his injuries and was pronounced dead at 1:55 am.  The victim was later identified as Kenneth Scott of South Prospect Street in Jackson.  He had just turned 24 on August 28.

On August 30, 2013, a post mortem examination was conducted on the body of Mr. Scott by Dr. Dante Ragasa of the Ocean County Medical Examiner’s Office. The  cause of death was determined to be a gunshot wound of the chest; the manner of death was ruled homicide.

The Lakewood Police Department and Ocean County Prosecutor’s Office Major Crimes Homicide Unit, with assistance from the Ocean County Sheriff’s Department CSI Unit, conducted a throrough investigation into the circumstances surrounding Kenneth’s death and the identity of his assailant.  Ultimately, the investigation revealed that Kenneth Scott was allegedly shot by Umbachi Jackson over an unpaid “Dice Game” bet.

On December 3, at 3:15 pm, the two lead detectives in the case, Ocean County Prosecutor‘s Detective John Carroll and Lakewood Police Detective Craig Fink, located and arrested Umbachi Jackson at the High Point Condominium Complex in Lakewood.   Umbachi Jackson was charged with Murder, Possession of a Weapon and Possession of a Weapon for Unlawful Purpose at the time of his arrest.

OCEAN COUNTY PROSECUTOR’S OFFICE EXPANDS PROGRAM TO EDUCATE OC CHILDREN OF ALCOHOL, DRUGS AND GANG DANGERS

Ocean County Prosecutor Joseph D. Coronato today announced the continued growth of the G.R.E.A.T. (Gang Resistance Education and Training) Program within the Office of the Ocean County Prosecutor and partnering county law enforcement departments. G.R.E.A.T. is a school-based, law enforcement officer-instructed classroom curriculum designed to prevent delinquency, violence and gang membership.

This past Friday (3/20), the Ocean County Prosecutor’s Office, Toms River Police Department and the Ocean County Sheriff’s Department collaborated to graduate the entire fifth grade class, approximately 200 children, of the Toms River Walnut Street Elementary School.

“Law enforcement must take proactive measures to prevent the spread of crime and violence,” stated Prosecutor Coronato. “The G.R.E.A.T. Program does that for those we hold most precious – our children. I commend the members of my Office and participating departments for working tirelessly to bring the program to so many of our area schools.”

OCPO brought the Six week program to Ocean County Schools in 2011 and have been continuously working cooperatively with other Ocean County law enforcement agencies to expand the program locally in an effort to reach as many children as possible. Detective Sandra Rodriguez of the Ocean County Prosecutor’s Office, the Lakewood Police Department and others have continued to implement the program successfully in Lakewood over the past three years. In another district, Detective Sergeant Renee Nauyoks of the Ocean County Prosecutor’s Office and others taught students last year at Toms River Intermediate East, West and Hooper Avenue Elementary Schools. In the coming weeks, OCPO will again partner with the Toms River Police Department and others beginning a new class on April 1st at West Dover and Washington Street Elementary Schools.

OCPO Note To Parents

 

Prosecutor Joseph D. Coronato today announced the newest video release aimed at raising awareness to the dangers of drugs.  “Note to Parents” is the third film to be added to the Ocean County Prosecutor’s Office “Right Turn” Educational Series.  Under the direction of Prosecutor Coronato, these films are being distributed across the entire county in all Middle and High Schools, as well as, to numerous state agencies and nationally to educational and policing partners.  They are being created through the Prosecutor’s Office Juvenile Justice Division under the direction of Supervising Assistant Prosecutor Anthony Pierro.  The films were created in response to Ocean County’s tragic overdose death toll.  Paid for with drug forfeiture monies seized from those arrested seeking to profit from the illegal sale of narcotics.

Prosecutor Coronato stated, “We must continue to be proactive in every possible way attacking Ocean County’s drug crisis.  These videos are a desperate effort to reach young adults before they tragically become victims of drug abuse.  I’m grateful that Brian Geraghty and other celebrities with roots in Ocean County are stepping up to join our efforts.  This video series is the perfect vehicle to capture teen’s attention, raise awareness, educate and hopefully prevent the tragedy of future addictions.”

“Note to Parents” is now featured on the Ocean County Prosecutor’s web site, along with the two prior, at www.oceancountyprosecutor.org.  This film, takes a different approach by being geared towards parents.  It focusses on a teenage boy who ultimately loses his life to substance abuse and a teenage girl who gets caught up in the web of substance abuse, tragically while their parents miss all the warning signs.    The film begins with a school teacher who is writing notes to the respective parents of these teenagers, highlighting changes in their behaviors, personalities, and school work.  The film takes the viewer on the unfortunate journey of drug addiction and illustrates the consequences associated with the terrible decision to be a part of that world.  The goal of the film is to give parents the tools to be able to prevent substance abuse from happening in their children’s lives.  It also serves as a resource, citing steps parents can take towards early intervention and paths to resolving addiction  should they suspect that their son or daughter has issues with substance abuse. 

     “Note to Parents” was produced by E-Video Productions, LLC of Toms River New Jersey.  Toms River native and Chicago P.D. actor Brian Geraghty introduces the film at the onset while describing the magnitude of the drug crisis in our county.  The film moves on with the main cast as the story begins.  The cast consists of students and teachers from the Performing Arts Academy in Lakehurst New Jersey.  The academy is part of our county’s vocational school system.  Characters in the main cast include student Antonio Dasti (Mike), student Brianna Ellison (Sara), and Theatre Instructor Laura Grandi-Hill (Mrs.) Lucasen.  Other students in featured roles are Stephanie Gulino, Bethany Harding, Joy Chanik, Rory Nilsen, Casey Conner, and Chase B. Theibault.  Supporting cast and extras in the film were also students and parents from the Performing Arts Academy.

Other significant contributions to “Note to Parents” came from world renowned guitarist and rock legend Richie Sambora who contributed his musical talents to the production.  Patricia Horner spoke towards the end of the film on the tragic loss of her beloved son Christopher as a result of a drug overdose.  “Note to Parents” is dedicated in loving memory to her son, Christopher Horner.

Other individuals who contributed to the production and were key to its success are as follows.  Karen Homiak: Principal of the Performing Arts Academy, Anthony Ciccotelli: Theatre Instructor for the Performing Arts Academy, and Mark Houck: Supporting Staff.  We must give special thanks to Amanda Balazs for the use of her house for filming and to the Brick Township Police Department for the use of its jail facilities during the filming of this production.  All of the school scenes were filmed at the Performing Arts Academy in Lakehurst New Jersey. 

Up next in the Right Turn film Series is a film called “Just This One Time.”  This film is geared towards a teenage audience and is intended to illustrate the perils and consequences of substance abuse.  In addition, it will outline how the social or recreational use of drugs can quickly become a lifelong addiction that can ultimately lead to death.  This film will be completed sometime during the month of April and will be rolled out shortly thereafter.

The first two videos in the series were:

“No Wasted Lives”: Guitarist Richie Sambora, who generously gave his time to tape the film’s introduction, as well as, writing and preforming the film’s opening music.  Members of the Ocean County Prosecutor’s Office, Point Pleasant Police Officers, Point Boro First Aid Squad members, Point Pleasant Board of Education members and thirty eight students were involved in the project.  Dramatic Arts Teacher Rebecca Muraglia of Point Pleasant High School solicited student involvement, auditioned and selected the student actors. 

“Night at the Prom”: Former MLB Pitcher Al Leiter generously gave his time to tape the film’s introduction.  The video was produced with the help of Brick Township Schools and focused on the danger of driving under the influence of alcohol.

SIX ARRESTED FOR CASHING WORTHLESS CHECKS

Ocean County Prosecutor Joseph D. Coronato today announced the arrest of six (6) county residents on the charge of Theft by Deception for allegedly operating a “Check Kiting Ring” in Ocean County.  The term “Check Kiting” is a banking industry label describing the illegal activity of depositing worthless checks then withdrawing cash before the banks can verify that the checks are worthless.

The investigation began in February of 2015, when TD Bank officials reported to the Ocean County Prosecutor’s Office Special Investigations Unit their suspicions regarding the alleged ring’s activity.  After an extensive investigation, the Ocean County Prosecutor’s Office developed information that the suspects had allegedly obtained over $10,000.

Earlier this week, the OCPO SIU enlisted the assistance of detectives from the Seaside Heights, Toms River, and Barnegat Police Departments to affect the arrests.  After a briefing at OCPO on 3/20/2015, the partnering agencies divided into arrest teams.  Armed with the required documentation for arrests, the teams departed OCPO-SIU at approximately 5:30 am and went directly to their target locations to affect the arrests.  The six suspects were arrested without incident at their residences, charged with Theft by Deception and lodged in the Ocean County Jail in lieu of various bail amounts.

GUILTY PLEA IN SEXUAL ASSAULT

Defendant Bonifacio t, 43, of Lakewood entered a guilty plea yesterday (3/25) before Judge James M. Blaney, J.S.C. to one count of 2nd Degree Sexual Assault.  Huerta is to be sentenced in the third degree range.  The prosecution led by Senior Assistant Prosecutor Terry Ann Linardakis is seeking 5 years in New Jersey State Prison under the No Early Release Act.  Defense is requesting 3 years (NERA).  Parole Supervision for Life, Megan’s Law Registration and Nicole’s Law (No Contact with Victim) will apply.

Conduct involved inappropriate sexual touching between June 2011 and May 2014 with a victim known to him who was between 10-12 years old.  The incidents occurred in Lakewood.  The investigation was conducted by Detective Melissa Matthews of the Ocean County Prosecutors Office and Detective Craig Fink of the Lakewood Police Department.  Sentencing will occur after an AVENAL evaluation.

BRICK TOWNSHIP STABBING ARREST

On Sunday, March 29, at approximately 9:53 pm, a 911 call was received by the Brick Township Police Department in reference to a stabbing at a Cedar Bridge Avenue Address.  Upon their arrival, they found a female, 50 years of age, within the residence who had been stabbed multiple times in her chest and abdomen.  The victim advised the officers that the individual who stabbed her was known to her and was still in bedroom of the residence.  Responding officers immediately called for EMS and secured the scene.  The victim was transported to Jersey Shore Medical Center in critical condition to be treated for over six stab wounds to her torso.

A search of the residence located the suspect covered in blood in the bedroom.  He was identified as Christopher Dalzell, 58, of Brick Township.  The subsequent investigation resulted in Dalzell’s arrest.  He was charged with Attempted Murder and Possession of a Weapon.  The Honorable Judge Francis Hodgson set bail at $250,000 no 10% and no contact with the victim.

Brick Township Police Detective Tim McCarthy and OCPO Major Crimes Detective John Murphy are the lead investigators in this case.  The scene was processed by Ocean County Sheriff’s Department CSI Detective John Anderson.

ARREST IN AGGRAVATED SEXUAL ASSAULT

On Monday, March 30, Ocean County Prosecutor Special Victims Unit Detective Stephanie Bayha and Brick Township Police Detective James Burgess arrested SAMUEL HOLDBROOK, 28, of Brick on charges of Aggravated Sexual Assault, Sexual Assault and Endangering the Welfare of a Child.

The investigation conducted by the partnering detectives alleges that the female victim, who was 12 at the time of the incident, was assaulted sometime between January and February 2014.  Holdbrook is someone with whom the victim is familiar.

He was arrested yesterday at approximately 8:30 pm at Brick Township Police Headquarters after the investigating detectives secured the necessary evidence to support the charge.  Ocean County Superior Court Judge Francis Hodgson was contacted and bail was set at $250,000.00 no 10%.  Nicole’s Law (no contact with the victim) was implemented.  He is lodged in the Ocean County Jail in default of bail.

OCPO CONTINUES DRUG INDUCED DEATH PROSECUTIONS MIDDLESEX COUNTY MAN CHARGED IN BRICK OVERDOSE DEATH

Ocean County Prosecutor Joseph D. Coronato and Brick Township Chief Nils Bergquist announce the arrest of Jesse Hay, 25, of South Plainfield, NJ, for causing the Drug Induced Death of Anthony Busby, 24, of Brick, NJ.  Hay is charged with Strict Liability for Drug Induced Death, Reckless Manslaughter, Distribution of Fentanyl, Possession of Fentanyl with the Intent to Distribute and Possession of Fentanyl.  His bail was set by Judge James M. Blaney, J.S.C. at $250,000 no 10%.      

The case stems from a December 19, 2014 incident.  On that date at 6:47 pm, the Brick Township Police and EMS were dispatched to a Marilyn Drive address for a report of an unconscious male.  Upon their arrival, they found Anthony Busby unresponsive.  Busby was pronounced deceased at 7:18 pm by Dr. Hinfey from Newark Beth Israel Hospital via telemetry.

As per Prosecutor Coronato’s mandate, an immediate investigation was started by the Brick Township Police Department, Ocean County Major Crime Unit, Ocean County Special Operations Group and the Ocean County Sheriff’s Department (CSI).  The partnering agencies immediately processed the scene, collecting all evidence of suspected narcotic activity and isolating evidence that could possibly lead to the dealer responsible for selling Busby the illegal narcotic.  Found at the scene were several white wax folds stamped with “730 Virus” in green ink and another ten wax folds stamped “Strike Dead” with the picture of the grim reaper in red and black ink.       

In the following months, the partnering agencies, with assistance from the Edison Police Department, North Plainfield Police Department and the South Plainfield Police Department, would develop information identifying Hay as a suspect.  On December 20, 2014, Dr. Ian Hood of the Ocean County Medical Examiner’s Office performed a post mortem examination on Mr. Busby’s body providing the final necessary piece to charge Hay with Busby’s death by confirming that Busby’s death was drug induced, caused by an excessive amount of fentanyl in his system.  The Medical Examiner’s report also confirmed that the wax folds stamped “730 Virus” and “Strike Dead” both contained the deadly additive Fentanyl.

Hay, who has been incarcerated continuously since his 12/23/14 arrest on the Possession and Distribution charges, was served his Drug Induced Death Arrest Warrant today at 12:45 pm in the Middlesex County Jail by members of the Ocean County Prosecutor’s Office Major Crimes Unit and Brick Township Police Department. 

The Office of the Ocean County Prosecutor has conducted 19 Drug Induced Death Investigations to date since the appointment of Prosecutor Coronato in March of 2013.  Six (6) defendants have pled guilty to Strict Liability charges and 2 codefendants have pled guilty to drug charges in the 19 separate cases.  Strict Liability enforcement is a major component of the OCPO efforts to stem the tide of opiate- related overdose deaths in Ocean County and to send a message to drug traffickers that Ocean County is not a place to do business.

Lightning Jack’s Marina Explosion Update

On Monday (4/6) at 2:33 pm, the Brick Township Police and Fire Departments were dispatched to Lightning Jack’s Marina for a boat explosion with an injured victim. Upon their arrival, a male subject was walking around on scene with burns to his head, arms and hands. Arrangements were immediately made to have the victim transported to Saint Barnabas Burn Center in Livingston by medical helicopter.

OCPO Arson Investigator Mitch Remig quickly responded to the scene and was able to interview the victim prior to his departure to the hospital. The victim, Kevin McDermitt, 39, of Toms River stated he was working on the vessel that was dry-docked in a garage at the marina. Det. Remig found that McDermitt was using a heat gun to fix a transducer under the deck of the vessel in the stern area. As he went to turn on an electric heat gun, he detected the odor of gasoline and suddenly an explosion occurred. It was noted that not all of the hatches were open on the vessel when the work was being done. The vapors were determined to originate from under the deck in the stern area. The cause of the accidental vapor explosion was from the use of the electric heat gun.
Mr. McDermitt’s injuries, fortunately, are not life threatening and he is expected to recover from his burns – Al Della Fave.

JACKSON SHOOTING INVESTIGATION

CCP2SgPUEAIcJD_Ocean County Prosecutor Joseph D. Coronato and Jackson Township Police Chief Matthew D. Kunz announce an active investigation into the fatal shooting of a 34 y/o Jackson Township man. The joint investigation by the OCPO Major Crimes Unit and Jackson Township Police has identified, located and is presently questioning persons of interest. Additional information will be released as the investigation develops.

Jackson Township Police initially responded to Casanova Restorante located at 10 South New Prospect Road, Jackson, just after 11 pm on a report of an injured employee. It should be noted the restaurant has been an inactive business for some time. Upon their arrival, the responding officers found the man’s body within the establishment. The male victim succumbed to multiple gunshot wounds.

JACKSON SHOOTING – SUSPECT QUICKLY APPREHENDED

Ocean County Prosecutor Joseph D. Coronato and Jackson Township Police Chief Matthew D. Kunz today announced the arrest of Hector Calderon, 47, of Freehold, NJ, in connection with the death of Peyman Sanandaji, 34, of Jackson, New Jersey.   As the result of a joint investigation by OCPO Major Crimes Unit and Jackson Township Police, Calderon was arrested within hours of the shooting death at his residence in Freehold, NJ.

Jackson Township Police initially responded to Casanova Restorante located at 10 South New Prospect Road, Jackson, just after 11 pm on 4/9 for a report of an injured employee. Upon their arrival, the responding officers found the body of Peyman Sanandaji within the establishment. Mr. Sanandaji succumbed to multiple gunshot wounds.

The responding officers immediately secured the scene and called for the OCPO Major Crimes Unit, Ocean County Sheriff’s Department CSI and the Ocean County Medical Examiner to respond. The subsequent investigation revealed that the victim was allegedly shot during the course of an altercation with Calderon. Having identified Calderon, the investigation quickly shifted to locating and apprehending him.

Calderon’s residence was identified as a South Street address, in Freehold Borough, New Jersey. Just before noon on April 10, OCPO Detectives John Murphy and John Carroll responded to the residence, along with the Freehold Borough Police and Monmouth County Prosecutor’s Major Crime Unit, and took Calderon into custody without incident.

Calderon is charged with Murder, Possession of a Weapon and Possession of a Weapon for Unlawful Purpose. His bail was set by the Honorable Wendel E. Daniels, P.J.Cr.P, at $1,000,000 cash. The defendant was remanded to the Ocean County Jail in lieu of bail.

SECOND SUBJECT CHARGED IN JACKSON SHOOTING INVESTIGATION

Ocean County Prosecutor Joseph D. Coronato and Jackson Township Police Chief Matthew D. Kunz announce a second arrest in the shooting death of Peyman Sanandaji, 34, of Jackson, New Jersey. The joint investigation by the OCPO Major Crimes Unit and Jackson Township Police Department has developed information implicating Daniele G. Romeodisantillo, 27, of Manalapan, NJ, in the shooting.

​Over the past week, the continuing investigation revealed that Daniele Romeodisantillo was also present at the time of the murder and that the shooting took place during the course of a meeting between Romeodisantillo, Calderon and the victim.

​Today at approximately 6:17 pm, Romeodisantillo surrendered himself to members of the Ocean County Prosecutor’s Office Major Crime Unit, at the Hooper Avenue Office of the Prosecutor. Romeodisantillo is charged with Murder, Conspiracy to Commit Murder and Possession of a Weapon for an Unlawful Purpose. The Honorable James M. Blaney, J.S.C., set bail at 1,000,000.00 cash only. The defendant was remanded to the Ocean County Jail in lieu of bail.

BRICK SERIOUS ACCIDENT

On Sunday April 26, 2015, at approximately 3:49 pm, Brick Township Police responded to the area of Route 88 and Jack Martin Boulevard for a report of a four (4) car motor vehicle crash involving serious injury.

The investigation by Brick Township Police Department, Ocean County Prosecutor’s Accident Investigation Unit and the Ocean County Sheriff’s department CSI found that a 1997 Acura, driven by Frank A. Ferrara, 31, (suspended DL) of Brick, was traveling East on Route 88 when his vehicle failed to stop for traffic ahead and collided into a 2013 Chevy Cruz, driven by Briana Ferlisi of Toms River, which was stopped in the eastbound lane.  The impact from the rear caused major rear end damage to the Chevy Cruz.  All occupants were restrained, however, Kimberly Ferlisi, 15, of Brick, a rear seat passenger, sustained the most serious injury to her head and neck from the impact.  She was taken to Jersey Shore University Medical Center for treatment.  The other two passengers received minor injury and were taken to Ocean Medical Center in Brick.  The driver refused medical attention.

From the force of the impact, the Chevy Cruz went forward impacting a second vehicle, a 2014 Jeep Cherokee, driven by David Bertone of Brick and his passenger Thomas Barten also of Brick.  Neither occupant sustained any injuries, and both refused medical attention at the scene.  The vehicle sustained minor damage and was driven from the scene.

A third vehicle was struck as a result of the collision which was caused by the Jeep Cherokee being pushed into a 2000 Honda Civic, driven by Sandra Herrera-Perez of Brick, who was also stopped at the intersection.   All four occupants in that vehicle were uninjured and refused medical attention.  The vehicle received very minor damage to the back bumper and also was driven from the scene.

Brick Police officers at the scene observed the at fault driver, Frank A. Ferrara, going in and out of his vehicle in an attempt to get rid of suspected CDS.  Ferrara also showed signs of impairment and several suspected narcotic wax folds were seen in plain view in and around the Acura.  Two syringes were also located on the ground near Ferrara when police approached him.  Ferrara was transported to Ocean Medical Center in Brick where a telephonic search warrant to obtain a blood sample for later testing was applied for and granted by Judge Liguori.

Ferrara was subsequently charged with: Tampering with Physical Evidence; Possession of CDS; Causing Serious Bodily Injury while Driving Suspended; Assault by Auto.  Bail was set at $50,000 with no 10%. Ferrara was lodged in Ocean County Jail.

OPERATIONS “BROKEN RULE” AND “SIN CITY” DISMANTLE MAJOR HEROIN NETWORKS

Ocean County Prosecutor Joseph D. Coronato announced today the culmination of two cooperative multi-jurisdictional narcotics investigations conducted by the Prosecutor’s Special Operations Group, along with federal, state, county and local law enforcement agencies. The investigations focused on high level heroin distributors found to be operating in Union, Ocean, Monmouth and Atlantic counties, as well as, Philadelphia, PA. During the course of the both investigations, approximately forty additional law enforcement personnel were assigned to the OCPO Special Operations Group. Multiple agencies within and outside Ocean County assisted in every aspect of both investigations. The investigations, identified as Operations “Broken Rule” and “Sin City” began in December of 2014 and culminated this week. The two heroin networks were responsible for the import of over a kilogram of heroin a week into Ocean County. A kilogram of heroin equates to approximately 50,000 individual dosage units of heroin.

Ocean County Prosecutor Joseph D. Coronato stated, “These simultaneous operations are incredible investigative feats. Beyond the approximate street value of over $325,000 in heroin seized during operations “Broken Rule” and “Sin City”, this outstanding Law Enforcement partnership has extended the reach and effectiveness of Ocean County law enforcement far beyond our borders.”

The investigation deemed operation “Sin City’ by the OCPO Special Operations Group identified Jonathan Gonzalez, 32, a.k.a. “Sin” (hence the name “Sin City”) of Pleasantville and Toms River as allegedly managing and directing a heroin distribution network in Ocean and Atlantic counties. The investigation revealed that Mr. Gonzalez was allegedly importing quantities of pre-packaged, as well as raw or uncut heroin into Ocean County for distribution. The investigation identified locations in Toms River where Gonzalez and members of his network would prepare and package the raw or uncut heroin for re-distribution into individual dosage units. The “Sin City” operation culminated during the evening hours of April 23, 2015, when detectives from the Special Operations Group surveilled Mr. Gonzalez along with Faythe Darling, 29, of Toms River and Miasia S. Johnson, 21, of Barnegat returning from Philadelphia with quantities of raw, uncut heroin, as well as packaging materials used to convert raw heroin into individual dosage units. Members of the Special Operations Group, along with members of the Manchester Police Department, conducted a motor vehicle stop on the vehicle utilized by Mr. Gonzalez and two other aforementioned Ocean County residents on Route 70 in the area of Route 539 in Manchester Township that resulted in their arrest on various drug charges.

Simultaneously with the arrests of Gonzalez, Darling and Johnson, members of the Special Operations Group and the partnering law enforcement agencies executed search warrants in Toms River, Barnegat, South Toms River, Brick Township and Pleasantville, NJ. As a result of the search warrants executed during operation “Sin City”, police seized approximately 25 grams of raw heroin, quantities of pre-packaged heroin, cash, packaging materials associated with the preparation, packaging and distribution of heroin. Police also searched and seized four motor vehicles that were identified as being utilized by this drug distribution network.

During the course of the second investigation, Operation “Broken Rule”, members of the Special Operations Group identified Ocean County residents specifically, Bertrick Artis, 45, a.k.a. “King Rule” (hence the name “Broken Rule”), of Lakewood and his son, Ashzon Artis, 25, also of Lakewood as allegedly importing heroin from the Elizabeth, New Jersey area into Ocean County. Operation “Broken Rule” culminated during the evening hours of March 31, 2015, when detectives from the Special Operations Group teamed up with members of the Union County Prosecutor’s Office Narcotics Task Force and members of the Elizabeth Police Department. The investigation led Ocean County Detectives to a mall in Elizabeth where Bertrick Artis, Ashzon Artis and Angelique Morris, 23, of Tinton Falls in Monmouth County were attempting to purchase quantities of heroin from Javier Cruz, 25, and Kennin Chavez, 19, from the Bronx, NY. Detectives from the Special Operations Group, Union County Narcotics Task Force and the Elizabeth Police Department subsequently arrested the aforementioned individuals who were then transported back to Ocean County. Their arrests were not announced earlier so as not to jeopardize the continuing “Sin City” operation.

Simultaneously with the arrests in Elizabeth, members of the Special Operations Group and the partnering law enforcement agencies executed five search warrants in Lakewood, Toms River, Lakehurst, Barnegat, Ocean Township (Waretown) and Jackson Township. As a result of the search warrants executed during operation “Broken Rule” police seized large amounts of heroin, cash, several illegal firearms to include an assault style firearm and packaging materials associated with the distribution of heroin. Police also searched and seized 10 motor vehicles that were identified as being utilized by this drug distribution network.

Both Operations yielded the arrest of 36 individuals on various drug and weapons charges, seized nearly 31,000 individual dosage units of heroin, approximately 25 grams of raw heroin, approximately $140,000 in cash, 14 motor vehicles (one of which was equipped with an electronic “TRAP” utilized to conceal CDS), six firearms to include a TEC- 9 assault weapon (All weapons seized in Operation Broken Rule) and materials consistent with a CDS manufacturing and production facility.

This investigation is continuing and additional arrests are forthcoming. Both operations involved the strength of the following agencies, in addition to the Ocean County Prosecutor’s Office Special Operations Group”:

OCEAN COUNTY PROSECUTOR STEPS UP TRAFFIC ENFORCEMENT FOR PROM SEASON AND THE COMING OF SUMMER TRAVEL TO THE SHORE CALLS FOR ZERO TOLERANCE DWI ENFORCEMENT

checkpointToms River, NJ – With Prom season and the busy summer travel season looming, Ocean County Prosecutor Joseph D. Coronato today announced the continuation of its’ annual countywide DWI checkpoint program. The program consists of staging numerous checkpoints throughout Ocean County. The program’s design creates a force multiplier by regionalizing and supplementing local DWI enforcement. The program will also conduct DWI enforcement patrols throughout the county. In making his announcement, Prosecutor Coronato reminded drivers that an extra measure of caution and not operating under the influence can prevent tragedy.

Prosecutor Coronato stated, “The start of Prom season and the added volume of summer shore traffic calls for increased vigilance by law enforcement, and that will be the focus over the coming months to keep motorists safe. We ask that drivers do their part by driving responsibly and making smart choices behind the wheel every day of the year.”

While inattentive and aggressive drivers are always targets of law enforcements’ regular patrols, the purpose of these efforts is to detect, educate, deter, arrest, and vigorously prosecute impaired drivers. The program targets those under the influence of alcohol, but in response to Ocean County’s drug crisis also utilizes an addition of two Drug Recognition Experts at each check point to detect those under the influence of narcotics. The county also oversees a county wide call out system for DRE’s to respond and assist agencies in conducting evaluations of subjects suspected to be operating a motor vehicle under the influence of narcotics.

Each year impaired drivers are responsible for about a third of the deaths occurring on Ocean County roadways. In 2013 Ocean County had 51 fatalities, the second highest number in the state. 2014 saw 46 deaths on Ocean County roadways.

The checkpoint program, which is funded in part by the Ocean County Board of Chosen Freeholders and the New Jersey Division of Highway Traffic Safety, will be conducted by local police agencies in conjunction with Detectives from the Prosecutor’s Office and Sheriff’s Department K-9 Unit focusing on both intoxicated and drug impaired drivers. The program is operated through the Prosecutor’s Vehicular Homicide Unit coordinated by Det. David Margentino under the direction of Assistant Prosecutor Patrick Sheehan.

ARREST OF BRICK TOWNSHIP SCHOOL’S SUPERINTENDENT

Ocean County Prosecutor Joseph D. Coronato announces today’s arrest of Brick Schools Superintendent Walter Uszenski, former Brick Schools Interim Director of Special Services Andrew Morgan and Jacqueline Halsey, the daughter of Walter Uszenski. The three were arrested today and charged with Official Misconduct and Theft by Deception for their roles in a scheme which was devised and orchestrated to provide a child of Jacqueline Halsey with educational services at public expense to which the child was not legally entitled.

It is alleged that Andrew Morgan, who became the Interim Director of Special Services for the Brick public school district in July of 2013, engineered a plan to provide Ms. Halsey’s preschool aged child with full time day care and transportation at the school district’s expense by falsely claiming that the program and services were educationally appropriate and necessary. The investigation revealed that Ms. Halsey initiated and approved the improper request and that both Morgan and Uszenski, the superintendent, executed the necessary approvals required for the Brick Board of Education to fund the program and related services. The amount of fraudulent benefits conferred is believed to be nearly $40,000.

The investigation revealed that Andrew Morgan initially was hired by the Brick Board of Education, at the request and recommendation of Uszenski, to conduct an “audit” of the Brick schools special services section in March of 2013. Uszenski and Morgan knew each other and had worked together before 2013. The $17,499 “audit”, which is approximately 7 pages in length, was critical of the job performance of the director of special services. Morgan was paid more than $83 per hour for 209 hours to prepare and write the “audit”. The “audit” also advocated saving the district money by providing services to special needs students in-district rather than sending those students out of district and paying private tuition. As a result of the “audit”, Uszenski recommended Morgan to the Board of Education to become the “Interim Director of Special Services”. The school board hired Morgan for that position. It is alleged that the “audit” was a pretense to position Morgan as the director of the special services section. He began serving on July 1, 2013. One of his first official acts was to engineer a fraudulent plan for Ms. Halsey’s child, who is also Uszenski’s grandchild, to receive unnecessary services and transportation at taxpayer’s expense.

The investigation also revealed that Morgan submitted false information in his application for employment with the Brick Board of Education. Morgan resigned from his position on December 31, 2013. He received in excess of $60,000 in compensation from the Brick Board of Education between March 1 and December 31, 2013.

Uszenski was taken into custody shortly after 9 am today at the Brick Board of Education Administrative Office. Morgan, accompanied by his attorney (William Strazza), turned himself into Ocean County Prosecutor Investigators at noon. Halsey was served her complaint summons at her home this morning.

Uszenski, Morgan and Halsey have been charged with the second degree crime of Official Misconduct and third degree Theft by Deception. Uszenski’s bail has been set at $100,000 with no ten percent option by the Honorable Francis R. Hodgson, Jr., J.S.C. Uszenski was also required to surrender his passport as a condition of bail. Ms. Halsey was released on her own recognizance.

TWO SEPARATE ARRESTS THIS PAST WEEK FOR SEXUAL ASSAULT

On Friday, May 8, 2015, Det. Joe Santoro of the Berkeley Police Department and Ocean County Prosecutor Special Victims Unit Det. Melissa Matthews charged David Hegyes, 38, of Bayville, with Sexual Assault and Endangering the Welfare of a Child.  The arrest was the result of an investigation initiated by the Berkeley Police Department.

On May 7, 2015, Ptl. Jonathan Mulvihill of the Berkeley Police Department responded to a 911 call from an adult female reporting Hegyes allegedly exposing himself and masturbating in view of the victim and her 4 year old granddaughter while at the Mill Creek Park Playground.

Upon his arrival, Ptl. Mulvihill located Hegyes in the playground area of the park and transported Hegyes to the Berkeley Police Department to continue the investigation.  Based on further investigation, Hegyes was charged with Lewdness and lodged in the Ocean County Jail.

On May 8, 2015, as part of the continuing investigation, Det. Matthews interviewed the victims and based on their statements Senior Assistant Prosecutor Terry Linardakis approved charges against Hegyes for Sexual Assault and Endangering the Welfare of a Child.  Bail was set by the Honorable Patricia Roe, J.S.C. at $75,000.  Nicole’s Law no victim contact order was implemented.  The defendant was served his additional charges at Ocean County Jail where he remained after being charged with Lewdness on May 7, 2015.

     The second arrest is the result of a 5/5/15 incident.  The adult female victim reported that Louis Kuka, 45, of Howell, came to her home to discuss a personal issue.  The victim alleges that once in the home, he physically attacked her, covered her mouth with duct tape and then duct taped her wrists behind her back.  The defendant then sexually assaulted her.  Following the assault, the defendant removed the duct tape from her wrists and departed the scene.

Jackson Township Police Department was notified and responded, along with Ocean County Special Victims Unit Det. Lindsay Woodfield, Ocean County Sheriff’s Department CSI Det. Stephen Capoano and Det. Robert Reiff of the Jackson Township Police Department to secure and process the scene.  The Ocean County Prosecutor’s High Tech Crime Unit also assisted in the investigation.  The investigating agencies were unable to locate Kuka initially and Ocean County Superior Court Judge Rowe issued an arrest warrant for Kuka.  Bail was set at $175,000.00 no 10%, along with Nicole’s Law being implemented.

On 5/7/15, Kuka surrendered himself to OCPO Det. Thomas Tiernan and Jackson Township Police Department Det. John Rodriguez without incident.  Kuka is charged with Aggravated Sexual Assault, Criminal Restraint and Aggravated Assault.  On 5/8/15, Judge Foster increased Kuka’s bail to $300,000 cash only.
